	Rebuilt and Used Parts and Units Limited Warranties and Exclusions 1. Rebuilt Parts and Units 2. Goody’s Truck Parts Inc., Used Goods Policy 1. Rebuilt Parts and Units 1.1. Limited Warranty Subject to the Exclusion and Disclaimer and Limitation of Warranties provisions below, Goody’s Truck Parts, Inc. (the “Seller”, “GTP”) warrants to Buyer as follows: All rebuilt parts and units are covered under this Limited Warranty for a period of 365 (three hundred sixty five) days from the Purchase Date. All rebuilt units and parts will conform in all material respects to the original manufacturer’s written specifications for the item and will be free from defects in materials and workmanship. This Limited Warranty covers parts only; it does not include labor, freight, towing, or any other incidental costs. Goody’s Truck Parts Inc. obligation under this warranty is limited, at Seller’s option, to repairing or replacing at GTP’s location, or refunding the Purchase Price of, any rebuilt parts or units or parts thereof that Goody’s Truck Parts Inc. determines do not conform to this Limited Warranty. Before GTP will accept a rebuilt part or unit returned for Limited Warranty consideration, Buyer is required to obtain GTP’s express return authorization. Return freight shall be prepaid by Buyer. Goody’s Truck Parts Inc., will accept units returned due to Buyer ordering error for 30 (thirty) days from the Purchase Date, subject to restocking charge of 25% of the unit price. The Limited Warranty for special order rebuilt units and parts covers repair and replacement only; no refunds will be issued for special order rebuilt parts and units. Special order rebuilt parts and units returned due to Buyer ordering error will not be accepted. 1.2. Exclusions from Limited Warranty Coverage The foregoing Limited Warranty covers normal use of the rebuilt parts and units in normal commercial vehicle applications. Goody’s Truck Parts Inc., does not warrant and is not responsible for: 1.2.1. Damage to goods used in any off-road equipment, in industrial applications, or in any other capacity besides normal commercial vehicle applications; 1.2.2. Damage to goods that have been altered, modified, or disassembled without GTP’s express authorization; 1.2.3. Damage caused by improper installation or maintenance; 1.2.4. Damage occurring during shipment, other than original shipment to Buyer if the Seller’s carrier is used; 1.2.5. Damage caused by any abuse, misuse, mishandling, or misapplication; or 1.2.6. Damage caused by a power surge or a natural occurrence such as fire, flood, wind, earthquake, lightning or any other considered to be Act of God event. 2. Goody’s Truck Parts Inc., Used Goods Policy – No Warranties, Expressed or Implied. GTP offers used goods “AS IS” and “WITH ALL FAULTS.” In accordance with the Disclaimer and Limitation of Warranty below, Buyer understands and agrees that all warranties implied by the provisions of the Ohio Uniform Commercial Code are excluded from the sale of used goods by Goody’s Truck Parts Inc. 3. Disclaimer of Title Against Infringement GOODY’S TRUCK PARTS INC., DISCLAIMS ALL WARRANTIES OF TITLE AND AGAINST INFRIGEMENT. The goods are sold subject to any claims of right, title, interest, infringement, or interference. 3.1. Express Warranties GTP HAS MADE NO AFFIRMATION OF FACT AND HAS MADE NO PROMISE RELATING TO THE GOODS BEING SOLD THAT HAS BECOME ANY BASIS OF THE BARGAIN MADE OR THAT HAS CREATED OR AMOUNTED TO AN EXPRESS WARRANTY THAT THE GOODS WOULD CONFORM ANY AFFIRMATION OR PROMISE. NO DESCRIPTION OF THE GOODS BEING SOLD HAS BEEN MADE PART OF THE BASIS OF THE BARGAIN OR HAS CREATED OR AMOUNTED TO AN EXPRESS WARRANTY THAT THE GOODS WOULD CONFORM TO ANY DESCRIPTION. NO SAMPLE OR MODEL HAS BEEN MADE PART OF THE BASIS OF THE BARGAIN OR HAS CREATED OR AMOUNTED TO AN EXPRESS WARRANTY THAT THE WHOLE OF THE GOODS WOULD CONFORM TO ANY SAMPLE OR MODEL. 3.2. Implied Warranties THE FOREGOING LIMITED WARRANTY COVERING REBUILT PARTS AND UNITS APPLIED ONLY TO THE ORIGINAL BUYER AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BUYER AGREES THAT, EXCEPT AS OTHERWISE PROVIDED GOODY’S TRUCK PARTS INC. LIMITED WARRANTY, THE GOODS ARE SOLD “AS IS” AND “WITH ALL FAULTS.” GTP UNDERTAKES NO RESPONSIBILITY FOR THE QUALITY OF THE GOODS AND ASSUMES NO RESPONSIBILITY THAT THE GOODS WILL BE FIT FOR ANY PARTICULAR PURPOSE FOR WHICH BUYER MAY BE BUYING THESE GOODS, EXCEPT AS OTHERWISE PROVIDED IN GDP’S LIMITED WARRANTY.

	Conditions of Use Goody's Truck Parts & Equipment, Inc., (hereafter referred to as the "Company" or "GTP" ) does not represent or endorse the accuracy or reliability of any of the information, content, or advertisements contained on, distributed through, linked, downloaded, or accessed from any of the services contained on Goodystruck.com. The site and it's services are provided by the Company on an "as is" basis. The Company expressly disclaims any and all warranties, express or implied, including without limitation warranties of merchantability and fitness for a particular purpose, with respect to the service or any materials and products. In no event shall the Company be liable for any direct, indirect, incidental, punitive, or consequential damages of any kind whatsoever with respect to the service, the materials, and the products.
